PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY 

Welcome to be-living.eu (the "Website"). These Terms and Conditions (the "Terms") govern your access to and use of the Website and your purchase and use of BE | LIVING products and services (together the "Services"). By using the Website or placing an order, you agree to be bound by these Terms. If you do not agree, you should not use the Website or purchase our products. 

BE | LIVING B.V. is established in the Netherlands and operates under Dutch and applicable EU law, including EU consumer protection rules for online purchases. 

1. Eligibility & Use of the Website 

1.1 You must be at least 18 years old and legally capable of entering into binding contracts under the laws of your country of residence to place an order via the Website. 

1.2 You agree to use the Website only for lawful purposes and in accordance with these Terms and all applicable EU and local consumer and e-commerce regulations. 

1.3 We may update or modify these Terms from time to time by posting a revised version on the Website; your continued use of the Website after changes have been posted constitutes acceptance of the updated Terms. 

2. Orders, Pricing & Payment 

2.1 By placing an order, you are making an offer to purchase the selected products under these Terms. We reserve the right to accept or reject any order, for example in case of stock issues, suspected fraud, or obvious errors. 

2.2 Product prices shown on the Website are displayed in the indicated currency and, where applicable under EU law, include VAT. Shipping costs, duties or additional charges (if any) are shown at checkout before you confirm your order. 

2.3 Payment is due at the time of order via the payment methods offered at checkout. Your order is confirmed once payment has been successfully processed and you receive an order confirmation email. 

2.4 In case of a pricing or description error, we reserve the right to correct the error, cancel the order, or contact you with the option to reconfirm or modify your order before shipment. 

3. Shipping, Delivery & Risk of Loss 

3.1 We ship to the countries listed on the Website. Estimated delivery times are provided as guidance only and are not guaranteed; delays can occur due to carrier issues, customs, or other circumstances beyond our reasonable control. 

3.2 Risk of loss or damage to the products passes to you when the products are delivered to the shipping address you provided and are accepted by you or your designated recipient. 

3.3 You are responsible for providing accurate and complete delivery information. We are not liable for losses or delays resulting from incorrect or incomplete addresses. 

4. Right of Withdrawal & Returns (EU Consumers) 

4.1 If you are an EU-based consumer, you have a legal right to withdraw from your online purchase within 14 days of receiving the products, without giving any reason, in accordance with the EU Consumer Rights Directive. 

4.2 To exercise this right, you must inform us within 14 days after delivery by sending a clear statement (e.g. email) that you wish to withdraw. You then have a further 14 days to return the products to us in unused, resellable condition with all original packaging and accessories. 

4.3 Upon timely withdrawal and receipt of the returned products, we will refund the product price and the standard outbound shipping costs (where required by law) via the same payment method you used, minus any permitted deductions for diminished value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the goods. 

4.4 Certain items may not be eligible for return under EU or local law (for example, used cookware that cannot reasonably be hygienically restored). Any such limitations will be clearly stated on the product page or during checkout where applicable. 

5. Warranty & Product Use 

5.1 All BE | LIVING cookware is backed by a 2-year manufacturer's warranty, covering manufacturing and material defects under normal household use, in addition to your statutory EU consumer rights. 

5.2 This warranty does not cover normal wear and tear, discoloration, cosmetic damage, misuse, neglect, overheating, failure to follow use & care instructions, or damage caused by commercial or professional use. 

5.3 For best performance and longevity, we recommend cooking on low to medium heat, using wooden, silicone or nylon utensils, and cleaning with warm water and a soft sponge. While many items are dishwasher safe, we recommend hand washing to preserve performance and appearance over time. 

5.4 BE | Living cookware is made using carefully selected materials and is PFAS-, PFOA- and PTFE-free, designed for even heat distribution, durability, and everyday comfort. This does not replace or limit any mandatory safety or conformity obligations under EU law. 

6. Materials, Safety & Compliance 

6.1 Our products are designed and tested to meet applicable EU and local safety, food-contact, and consumer regulations in the markets where they are sold. 

6.2 You are responsible for using the products in accordance with the instructions, including compatibility with your cooktop, oven limits (if applicable), and local safety norms. Failure to follow the recommended use & care may void the warranty. 

6.3 Where legally required, the conformity of your product with the contract is guaranteed for the minimum statutory period in your country of residence; this may be longer than our commercial warranty. 

7. User Accounts, Content & Intellectual Property 

7.1 You may create an account on the Website to manage orders, wishlists or preferences. You are responsible for maintaining the confidentiality of your login details and for all activities under your account. 

7.2 All content on the Website (including text, images, graphics, logos and designs) is owned by or licensed to BE | LIVING and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or use any Website content for commercial purposes without our prior written permission. 

7.3 If you submit reviews, photos or other content ("User Content") to the Website or to us (e.g. via social media, email or reviews), you grant BE | LIVING a non-exclusive, worldwide, royalty-free license to use, reproduce, display, adapt and share such content in connection with our products, marketing and Services, in compliance with applicable privacy and consumer laws. 

8. Privacy 

8.1 We process your personal data in accordance with our Privacy Policy, which explains what data we collect, how we use it, and your rights under EU data protection law (including the GDPR). 

8.2 By using the Website and placing an order, you consent to the processing of your personal data as described in our Privacy Policy, including sharing data with service providers (such as payment processors and logistics partners) where necessary to fulfil your order. 

9. Limitation of Liability 

9.1 Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by our negligence, fraud, or breach of mandatory consumer rights.
